Legislature Update

The Legislature is just past the mid-point in the session with 1,708 bills introduced, 16 signed into law and none vetoed  by the Governor. At this point, 44 bills have passed and 42 have been signed into law. March 5 marked the 56th day of session, which is just past the half-way mark in the ideal 100-day legislative session that would end on April 20. However, this is a target date and the President of the Senate and the Speaker of the House routinely extend that date to adjourn until sometime in May or early June in the event that the budget has not yet been passed or there are additional bills that the Majority Leadership in both houses feel merit the opportunity to continue through the process to the final two votes by all the members in that chamber.
Friday, March 26, is the last day that House bills can be heard in the Senate and Senate Bills in the House. After that date, any bills that have not had a hearing in the other chamber have failed and can no longer advance in the process. With a razor thin Republican majority in both the Senate, 16 to 14, and the House, 31 to 29, the date may be extended if there are any COVID-19-related illnesses or other health issues that might prevent a legislator from voting remotely. To date, all members, even one from the hospital, have been able to vote either on the floor, in their office or remotely out of the building.
March is traditionally the month that budget negotiations between the House, Senate and the Legislature get underway. The state currently has a budget surplus of $1.2 billion dollars. The House and Senate both have bills pending to decrease personal income tax levels as well as commercial property rates. Whether they will pass is unclear, but there does appear to be strong support from the business community to decrease the personal income tax level. Additionally, continuing federal revenue from the recently passed $2.9 billion federal COVID-19 relief legislation will bring in more funds. The unemployment benefits from that legislation of an additional $300 a week will continue through September.
There are also bills in the state House and the Senate to increase the amount of the state benefit. Arizona ranks second to lowest in the country and there is a great deal of pressure from legislators and others to increase the amount. The first bill is HB2805, sponsored by Representative Cook, that would raise the cap from the current $240 a week to $300 a week. Over the 26 week period, the new proposal totals $7,800. The bill would also increase the income disregard amount for part time workers from $30 a week to $160 a week. On March 24, HB2805 passed the House with a vote 50-9.
President Fann introduced the other unemployment benefit bill as a strike-everything amendment to SB1411. As passed in Senate appropriations on March 24, the strike-everything amendment proposes to raise the unemployment benefit cap from $240 a week to $320 a week. However, the cap would only extend for 20 weeks instead of the current 26 weeks during periods when the unemployment insurance fund is running at a very low level due to a high volume of claims. Over the adjusted 20 week period, President Fann’s proposal would total $6,400. SB1411 passed Senate rules on 2/24. Both bills increase the cost for employers from $7,000 to $8,000  the first and second year. President Fann’s bill also includes identifying security requirements. In tandem with these bills, the legislature is looking at increasing the unemployment fund once the federal funds have been allocated and there is a clearer number on what it is without the federal funds included. During the time those funds are available in the fund, the thought is to utilize them before assessing what increase is necessary for the long-term.

Construction to widen I-10 between SR 85 and Verrado Way will start in the Spring of 2021. Two new interchanges at Miller and Watson roads are also part of this project.
