Mesquite Business Licensing Code Update

The City of Mesquite Development Services Department recently conducted an audit of the business licensing code.  As a result of the review, code amendments are being proposed that will eliminate archaic requirements, clarify several poorly worded sections, simplify business license application information and establish equitable requirements amongst similar businesses.  The potential changes would impact cosmetologists, lawyers, insurance agents, dentists, doctors, miscellaneous service businesses and public utilities.

In an effort to make the code more user-friendly, the draft changes to Title 2 of the Mesquite Municipal Code also proposes creating some much-needed business classifications, while consolidating others. Several business classifications will also receive definitions or clarifications.

Among other revisions, a new chapter will be added to Title 2 for public utilities that will gather all the disparate public utility code sections and consolidate them into one place.  Additionally, the public utility chapter will be updated to comply with Nevada Revised Statutes.  

While reviewing the code, the business license team investigated neighboring jurisdiction costs on related licenses types and found some City of Mesquite fees to be too high, while others were too low, and will recommend adjusted fees accordingly.

Overtime Pay Regulation Update

If your business has exempt (aka salary) employees, this is very important to you and your budget planning.

Key Provisions of the Final Rule

The Final Rule focuses primarily on updating the salary and compensation levels needed for Executive, Administrative and Professional workers to be exempt. Specifically, the Final Rule:

  1. Sets the standard salary level at the 40th percentile of earnings of full-time salaried workers in the lowest-wage Census Region, currently the South ($913 per week; $47,476 annually for a full-year worker);
  2. Sets the total annual compensation requirement for highly compensated employees (HCE) subject to a minimal duties test to the annual equivalent of the 90th percentile of full-time salaried workers nationally ($134,004); and
  3. Establishes a mechanism for automatically updating the salary and compensation levels every three years to maintain the levels at the above percentiles and to ensure that they continue to provide useful and effective tests for exemption.

Additionally, the Final Rule amends the salary basis test to allow employers to use nondiscretionary bonuses and incentive payments (including commissions) to satisfy up to 10 percent of the new standard salary level.

The effective date of the final rule is December 1, 2016. 

The initial increases to the standard salary level (from $455 to $913 per week) and HCE total annual compensation requirement (from $100,000 to $134,004 per year) will be effective on that date. Future automatic updates to those thresholds will occur every three years, beginning on January 1, 2020.

Drug Testing Alert - Enforcement Of New OSHA Rule Begins November 1

In the spring of 2016, the Occupational Safety and Health Administration (OSHA) issued a new final rule requiring employers to begin electronically reporting injury and illness data. This portion of the rule's requirements will be phased in during 2017 depending on your industry and how many employees you have. You can find more information here
