New 1-9 Form Issued

Kamer Zucker Abbott

New I-9 Form Issued - To Be Used By January 22, 2017

The U.S. Citizenship and Immigration Services (USCIS) has published a revised version of Form I-9, Employment Eligibility Verification, which is dated November 14, 2016.  Employers must begin using the new form by no later than January 22, 2017.

Form I-9 requirements were established in November 1986 when Congress passed the Immigration Reform and Control Act (IRCA). IRCA prohibits employers from hiring people, including U.S. citizens, for employment in the United States without verifying their identity and employment authorization on Form I-9.

USCIS reports the following changes to the form:
  • Instead of asking for "other names used" in Section 1, the new form seeks "other last names used."
  • The certification for foreign nationals has been streamlined.
  • Prompts have been added to ensure information is entered correctly.
  • Employers may now enter multiple preparers and translators.
  • A dedicated area for including additional information has been added.
  • A supplemental page for the preparer/translator has been added.
  • The instructions have been separated from the form and specific instructions are provided for completing each field.
  • The form has been enhanced to make it easier to complete on a computer.

To access the new paper form, click here. To access other versions of this form (such as the electronic version or Spanish version) or the instructions, click here.

New Overtime Rule Temporarily Blocked

On Tuesday, November 22, 2016, a federal court issued a preliminary injunction to temporarily block the U.S. Department of Labor (DOL) from implementing and enforcing its Final Overtime Rule nationally, pending further order by the court.

What does this mean to you?

    • As a result of the ruling, employers currently do not need to
comply by the original December 1 effective date.

    • The injunction is temporary pending further review by the court.

    • We have no way of knowing if or when the status of the regulations
      will change.

If you want to learn more about the Overtime Rule as it was originally written, we suggest that you visit the DOL website
