Did you know the laws have changed? Since January 1, 2022, New Mexico has implemented new regulations on how businesses can legally work with and hire Independent Contractors. Additionally, in March 2024, the Department of Labor finalized a rule enforcing these laws, making it more challenging to work with Independent Contractors.
Did you know that fines can be astronomical if a business is found to be working with Independent Contractors who should be classified as Employees? New Mexico does not have a set penalty amount, meaning fines can exceed those in California, where penalties range from $5,000 to $25,000 per violation. If misclassification is found to be intentional, jail time may also be imposed.
