Did you know whether you offer group health insurance to your employees or not, you are most likely still required to make your employees aware of coverage options available through a Health Insurance Marketplace?  The deadline for this required notification is October 1, 2013  and there are substantial penalties for failure to comply with FLSA section 18B! 
 
The link for Technical Release 2013-02 is http://www.dol.gov/ebsa/newsroom/tr13-02.html and is also attached for your convenience should you like to review the details to avoid non-compliance.  Employers failing to deliver the Notice would be violating the FLSA and the ACA, and may be subject to investigation and penalties.  Employees complaining about not receiving the Notice (or reporting the violation) would have employment protections under the ACA.
 
Attached are model notices for both employers who do and do not offer health plans.  We urge you to fully review the compliance requirements and make notification to your employees as your specific circumstances dictate.
