Retaliation Claims and Employment Practices Insurance

Robert Keogh, Diversified Insurance

The courts are beginning to see more claims against employers from disgruntled employees. Our firm had an unemployment claim paid to an employee who elected to not show up for work because the employee claimed that there was a change in her duties as a result of her not agreeing with management. These claims are hard to defend and make for a significant target for employers.  For more information, click this link to take a look at our September Newsletter.

OHIO’S NEW DRIVING WHILE TEXTING LAW

Effective August 31, 2012, the State of Ohio has a ban on operating a motor vehicle while utilizing an electronic wireless communications device.

Ohio Revised Code (ORC) 4511.204 (Driving While Texting) makes it a secondary offense for all drivers 18 and over to drive using a handheld electronic wireless communications device to write, send, or read a text-based communication.  Adult drivers cannot be stopped for a violation of this section if this is the only violation observed by police.

ORC 4511.205 (Use of Devices by Persons Under 18 Years of Age) has made use of any manner of electronic wireless communications device a primary offense for all drivers under the age of 18.  Any juveniles who violate this section are subject to a fine of $150.00 in addition to a 60-day license suspension.  If a juvenile has previously been convicted of this section, the fine is $300.00 and a license suspension of one (1) year.  Juvenile drivers can be stopped for a violation of this section even if this is the only violation observed by police.

In accordance with the new law, officers will be issuing warnings for the first six (6) months once the law comes into effect.  After the six (6) months, violations of these sections may result in the issuance of a traffic citation by police.
